As 'Climpach' (company), we process your personal data with high care and sensitivity, when necessary, within the scope of the services and other activities we offer. In this regard, your personal data can only be processed with a great understanding of responsibility within the scope specified below in cases where our company has the title of the data controller and/or data processor in accordance with the Personal Data Protection Law No. 6698 ("Law"), which came into force on April 7, 2016. This text has been written to inform you about processing your personal data and to enlighten you on the basis on which your data is processed.

​1. Which Personal Data Is Processed and How Is It Processed?

Your personal data is processed verbally, in writing, or electronically through automatic or non-automatic methods, such as call centers, websites, and social media. Due to your interest in or use of the services and products of Climpach and its brands, the following personal data (including but not limited to the ones listed) that you have provided to us and/or can be updated may be processed:

  • Your name, surname, TR ID number, date of birth, and other data included in your identity,

  • Customer representatives keep your voice call records in accordance with call center standards,

  • If you visit our offices, your camera footage,

  • If you visit our offices, your vehicle data, such as license plate,

  • If you become a Climpach business partner, your financial data, such as bank account number, IBAN, billing information to fulfill the contracts,

  • An activity certificate, professional chamber registration, etc., is obtained within the scope of the execution of the contract. Provide professional data and the signature circular provided if necessary and your signature,

  • If the nature of the relationship requires it, your visa/passport data,

  • If you are a Climpach employee or work for an employer that is in business partnership with Climpach, Your education data, your service contract within the framework of your employment relationship, your aptitude for work and your performance, your health data, your data regarding private health insurance and financing; Your Social Security Institution data; TR ID number, your visa/passport data; Your vehicle data and other personal data that may be processed within the scope of your service contract, including but not limited to,

  • Your other personal data, including your CV that you submit directly to Climpach if you apply for a job.

 

2. For what purposes is your personal data processed?

Our company informs data subjects while obtaining personal data due to KVKK and related legislation. In this context, the Company makes a notification/information regarding the purpose of data processing, transfer of the data and to whom the data shall be transferred, the method of collecting personal data, and the legal purpose of collecting personal data.

The purpose of processing personal data information varies according to the relationship between the company and the personal data subject and the legal nature of the business.

  • Within the scope of legal, technical, and commercial security measures among parties about the Company, data is processed under the;

  • Notifying the relevant authorities/institution and conducting responsibilities within the audit processes

  • Assuring security measures in physical and electronic environments for the parties the Company is involved with

  • Keeping records as per commercial security measures and organizing, conducting, and auditing these measures for the parties the Company is involved with

  • Assuring the applicable activities are being conducted regarding data accuracy and ensuring the data is up to date.

  • Planning and conducting the Health & Safety processes

  • All guest entrances – exits are recorded within the legal requirements and applicable to the legislation

3. To whom is your personal data transferred?

a. Local Transfers
Personal data is not transferred to any third party without explicit consent unless it is legally required due to KVKK, relevant legislation, and cases where it is mandatory to be shared with the external parties due to administrative/juridical issues. However, as per Article 5 and Article 6 of KVKK, in case legal grounds are present and it is legally required, consent / explicit consent will not be observed on third-party transfer.
Our Company fulfills its obligation to inform the Data Subject regarding this transfer. Accordingly, the institutions, organizations, and/or persons that can be transferred are listed below.

b. Transfers to Abroad
The Company may transfer personal data abroad by obtaining the data subject's explicit consent and taking appropriate and necessary security measures foreseen in KVKK and related legislation. For the situations in which the explicit consent of the data subject is not sought, it is considered whether the country where the data will be transferred is in "adequate country" stature and has enough protection. If the Authority considers that the transferee country is not in adequate country statute, the Authority approval should be taken, and a data transfer protocol should be signed to guarantee enough protection.

c. Parties Conducting the Transfers 

  • Within the scope of the Labor Law, Obligations Law, Income Tax Law and Procedures, Commercial Law, Private Employment Agencies, and relevant legislations;

    • Related public institutions and organizations,

    • Competent authority,

    • Tax offices work with workplace inspectors, İşKur, regional labor, and SGK can be shared with administrative institutions and organizations.

  • Apart from these, our Company shall not disclose your personal data in accordance with Articles 8 and 9 of KVKK and take all security measures specified in the relevant legislation;

    • To business partners, suppliers, business partners that we cooperate with at local and/or abroad,

    • Data can be transferred to externally supported law offices, courts, and other official and judicial authorities upon request.

4. For what legal reasons is your personal data processed?

Your personal data is processed in line with the purposes mentioned above and in full compliance with the principles set out in the Law to fulfill Climpach's committed obligations under the contractual terms and conditions and by its rights and obligations regulated under the law.

 

5. What are the Precautions for the Security of Your Personal Data?

Climpach takes technical and administrative measures using possible technological means to prevent the unlawful processing of your personal data and to ensure the necessary security level to safeguard your personal data safely.
